Services Offered
CARRIER represents and warrants that it is duly and legally qualified to provide the transportation services contemplated herein. CARRIER agrees to comply with all applicable federal, state and local laws regarding the provision of such services. CARRIER will perform transportation with reasonable dispatch, but is not responsible for compliance with any specific shipping schedule or appointment times.
Acceptance of Terms
By using our services, you acknowledge that you have read, understood, and agree to be bound by these terms.
User Responsibilities
Users of our logistics services are expected to:
- Provide accurate and complete information for shipments
- Ensure that shipments comply with all applicable laws and regulations
- Properly package and label shipments
- Pay all fees and charges associated with the services
Payment Terms
Payment for our services is due upon receipt of the invoice unless otherwise agreed upon in writing. We accept various forms of payment, including credit cards, wire transfers, Zelle Transfers, and checks. Late payments may incur additional fees.
CUSTOMER agrees to pay CARRIER within thirty (30) days of receiving the invoice, with interest accruing monthly at a rate of 1.5% per month (18% APR) on any unpaid balance. CUSTOMER shall also be liable for any expenses, including attorney fees, CARRIER incurs in collecting its rates and charges. In the event of failure to pay freight charges as due, CARRIER shall be entitled to a general lien on any cargo in the possession of CARRIER which is tendered or owned by CUSTOMER regardless of whether such freight charges apply to the cargo in the possession of CARRIER.
Liability and Insurance
Our company is committed to handling your shipments with the utmost care. However, we are not liable for any loss, damage, or delay caused by circumstances beyond our control.
CARGO LOSS, DAMAGE, OR SHORTAGE; ALL-GROUND TRANSPORTATION
CARRIER’s liability for loss, damage, shortage or delay with respect to any cargo not subject to the preceding section shall be as a “carrier” pursuant to the Carmack Amendment as currently codified at 49 U.S.C. § 14706 and as amended from time to time.
FORCE MAJEURE
CARRIER shall not be liable for any delay in the performance of obligations hereunder if performance by CARRIER is affected or prohibited by any cause beyond CARRIER’s reasonable control, including without limitation, fire, labor strife, riot, war, weather conditions, acts of the public enemy, acts of God, acts of terrorism, local or national disruptions to transportation networks or operations, material equipment repairs, fuel shortages, governmental regulations, or governmental request as requisition for national defense, or requests of governmental officials.
Claims and Dispute Resolution
In the event of a dispute or claim related to our services, users must contact us within 30 days of the incident. We will investigate the matter and work towards a resolution. If a satisfactory resolution cannot be reached, the matter may be referred to arbitration in accordance with the rules of the American Arbitration Association.
Termination of Services
We reserve the right to terminate or suspend access to our services at any time, without notice, for conduct that we believe violates these terms or is harmful to our interests or the interests of others. Users may also terminate their use of our services at any time by notifying us in writing.
Modification of Terms
We may update or modify these terms of service at any time. Any changes will be effective immediately upon posting on our website. Users are encouraged to review the terms regularly to stay informed of any updates.
Governing Law
These terms of service are governed by and construed in accordance with the laws of the State of Florida. Any legal action or proceeding arising out of or relating to these terms shall be brought exclusively in the courts located in Florida.
Severability
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable.
Entire Agreement
These terms of service constitute the entire agreement between the user and our company regarding the use of our logistics services and supersede any prior agreements or understandings.
